Terms of Service

These Terms govern your access to and use of Uptrend Hunter (the “Service”), operated by Erkan Ecom LLC (“we,” “our,” or “us”). By accessing or using the Service, you agree to these Terms.

Nature of the Service

Uptrend Hunter is an independent e-commerce research and analytics tool. The Service analyzes recurring marketplace search observations and transforms them into charts, relative rankings, and momentum-related metrics. Relative Search Rank is a directional popularity indicator. It is not exact search volume, unit sales, conversion data, advertising performance, or a forecast.

Signals, methodology, and availability

Uptrend Hunter calculates independent metrics from the observations available in the active service. Coverage, input fields, update timing, calculation methods, and historical availability may change. Observations can be incomplete, delayed, corrected, removed, or discontinued, so we do not warrant that any signal or feature will remain available in its current form.

We may limit, modify, suspend, or remove observations, reports, exports, or related features when reasonably necessary to address quality, security, legal, contractual, or platform-policy concerns.

Independent product and platform rights

Uptrend Hunter is an independent product and is not affiliated with, sponsored by, or endorsed by any marketplace or commerce platform. Platform names and marks belong to their respective owners.

Access to Uptrend Hunter does not transfer, sell, or sublicense rights in underlying observations, platform materials, or trademarks and does not replace any permissions required for your own marketplace or commerce accounts.

Permitted use and exports

Subject to your plan and these Terms, you may use the Service and ordinary plan-limited exports for your internal business research. An agency or consultant may include limited analysis and conclusions in a deliverable for the specific client for whom the research was performed, provided that the deliverable does not expose or transfer a reusable dataset.

You may publish your own conclusions or isolated examples from the Service if you do not publish bulk observations, enable reconstruction of the service dataset, imply platform affiliation or approval, or violate another party’s rights.

Prohibited use

You may not:

• scrape, crawl, use bots against, or otherwise automate extraction from the Service without our prior written permission;
• bypass plan limits, rate limits, access controls, or security measures;
• combine repeated queries or exports to reconstruct the underlying dataset;
• sell, sublicense, republish, redistribute, mirror, or disclose bulk source observations or bulk Service outputs;
• use the Service or its exports to create or supply a standalone dataset, data feed, API, substitute service, or competing database;
• share credentials in a way that bypasses account or plan limits, disrupt the Service, reverse engineer protected components, or use the Service to violate law or third-party rights.

Research only; no guarantees

The Service is an input to research, not business, legal, financial, advertising, inventory, or investment advice. A better rank or Momentum Score does not guarantee demand, sales, conversion, profitability, product success, or future performance. You are responsible for independently checking competition, margins, intellectual-property constraints, suppliers, advertising data, seasonality, and other factors before acting.

Account responsibilities

You are responsible for providing accurate account information, maintaining the confidentiality of your credentials, and notifying us of suspected unauthorized use. You are responsible for activity performed through your account unless prohibited by applicable law.

Subscriptions, lifetime access, and payments

Paid access is billed in advance through an authorized payment partner or Merchant of Record. Monthly plans renew according to the interval shown during checkout. “Lifetime” means access to the current core Uptrend Hunter Pro platform for the commercial lifetime of the Service; future standalone products, agency plans, APIs, or premium add-ons may be sold separately. Prices, taxes, renewal terms, and cancellation options are shown before purchase.

Cancellation and refunds

You may cancel a recurring subscription through the available billing portal. Access generally continues until the end of the paid billing period. A full refund removes paid access, including lifetime access. Refund requests are handled under the published Refund Policy and applicable payment-partner rules.

Intellectual property

The Service interface, Uptrend Hunter brand, software, original content, scoring methods, and derived presentation are owned by Erkan Ecom LLC or its licensors. These Terms grant a limited, revocable, non-exclusive, non-transferable right to use the Service; they do not transfer ownership of the Service or any underlying third-party material.

Disclaimers and limitation of liability

The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and warranties arising from course of dealing or usage.

To the maximum extent permitted by law, Erkan Ecom LLC and its service providers will not be liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages, or for losses caused by decisions made using the Service. Our total liability arising out of or relating to the Service will not exceed the amount you paid for the Service during the 12 months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot legally be limited.

Changes, suspension, and termination

We may update the Service or these Terms and may suspend or terminate access for misuse, security risk, non-payment, legal or platform-policy concerns, or material violation of these Terms. If a change is material, we may provide notice through the Service or by email where reasonably practicable.
